Terms of Service

1. Acceptance of Terms

FishMind Technologies Pty Ltd ("we", "us", "our") operates the AeroPilot platform accessible at aeropilot.com.au and app.aeropilot.com.au. By accessing our website or using the AeroPilot platform, you agree to these terms. If you do not agree, do not use the service.

2. Service Description

AeroPilot provides monitoring and reporting for blower and aeration equipment. The service may include data collection, storage, visualisation, alarms and reports through a web dashboard.

3. Limitations of Service

AeroPilot is a monitoring tool, not a control system. It does not automatically start, stop or adjust equipment. Operators remain responsible for responding to alarms and maintaining equipment. We do not guarantee zero downtime or zero data loss.

4. User Obligations

You agree to:

  • Provide accurate information when creating an account
  • Keep login credentials secure and confidential
  • Not use the service for any unlawful purpose
  • Not attempt to reverse-engineer, decompile or interfere with the platform
  • Notify us promptly of any unauthorised access to your account

5. Data Ownership

You retain ownership of telemetry generated by your equipment. You grant us permission to store, process and display this data to provide the service. Anonymised, aggregated data may be used to improve the platform. We will not sell or share your raw telemetry with third parties.

6. Intellectual Property

The AeroPilot platform, including its software, design, documentation and branding, is owned by FishMind Technologies Pty Ltd. Nothing in these terms grants you any right to use our trademarks, logos or brand elements without written permission.

7. Availability and Support

We target 99.9% uptime for the cloud platform. Planned maintenance will be communicated in advance where practical. The gateway can buffer readings locally during a cloud outage. Support enquiries are handled via email during Australian business hours.

8. Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special or consequential damages arising from your use of the service. Our total liability is limited to the fees you have paid in the 12 months preceding the claim. This does not exclude or limit liability that cannot be excluded under Australian Consumer Law.

9. Termination

Either party may terminate the service by providing written notice. Upon termination, we will make your data available for export for a reasonable period (minimum 30 days). After that period, we may delete stored telemetry and account data.

10. Changes to Terms

We may update these terms from time to time. Material changes will be communicated via email or a notice on the platform. Continued use of the service after changes constitutes acceptance of the updated terms.

11. Governing Law

These terms are governed by the laws of Victoria, Australia. Any dispute arising from these terms will be subject to the exclusive jurisdiction of the courts of Victoria.
